As Katie Holmes and Tom Cruise face the agonising reality of their divorce, it seems that Katie’s focus is on getting sole custody of their 6-year-old daughter Suri.

Speculation surrounds the couple’s extensive pre-nup agreement, with reports claiming Katie intends to overturn the original £10million settlement. But, Katie’s representative Jonathan Wolfe, was clear about her main concerns. Jonathon said, “Katie’s primary concern remains, as it always has been, her daughter’s best interest,” MarieClaire.co.uk reports.

It’s thought Katie’s decision to file in New York is a message of intent to husband Tom. Paul Talbert, partner at Chemtob Moss Forman & Talbert LLP, told E! Online, “If she filed in New York, as opposed to Colorado or California, that would lead me to believe that there is a significant purpose to that filing, and my best guess is that this is where she wants to live with Suri.”

The Mail Online explains, “New York family law judges do not like giving fighting parents joint custody because they believe that causes endless conflicts in the children or children’s lives.”

Tom could look to move proceedings to California, where it’s believed he’s more likely to get joint custody. Tom may assert that Katie doesn’t meet the residency requirements to file in New York, reports the Mail Online.

Tom’s adopted children with ex-wife Nicole Kidman remain under a joint custody agreement, reports E! Online, and a source told RadarOnline.com, “There is absolutely no way that he is going to let Katie have sole custody.”

Scientology, the religion Tom is famed for embracing, is believed to have played its part in Katie’s plans.

The Church of Scientology is often criticised for charging large sums of money for its spiritual services. The Church claims, among many things, that people are immortal beings who have forgotten their true nature.

The Mail Online states, “With sole custody of Suri, Holmes would be able to remove her daughter from the Church of Scientology, which she is alleged to dislike and distrust, despite her husband’s enthusiasm for it.”

Rupert Murdoch recently tweeted, “Watch Katie Holmes and Scientology story develop. Something creepy, maybe even evil, about these people.”

Suri’s recent outings separately with her parents now appear to be hints that the divorce was on the cards. Let’s hope Suri gets a say in all this and that the outcome is what’s best for her.
